1. Acceptance of These Terms
By creating an account or using GiftAhead, you agree to these Terms of Service.
If you do not agree with these terms, please do not use the application.
You must have the legal capacity required in your country to enter into these Terms and make purchases. If you are a minor, you may use GiftAhead only with the permission and supervision of a parent or legal guardian where required.
2. About GiftAhead
GiftAhead helps users organize recipients, occasions, reminders, and gift recommendations.
GiftAhead is provided on an "as available" basis.
3. User Accounts
You are responsible for:
- Providing accurate account information
- Keeping your login credentials secure
- Activities that occur under your account
You may delete your account at any time through the application.
If you enter information about a gift recipient or another person, you are responsible for having an appropriate basis to provide and use that information. You must not enter unlawful, unnecessarily sensitive, or infringing content.
4. Gift Recommendations
Gift recommendations and product-search terms are generated using information you provide and automated systems, including AI services.
Recommendations are provided for informational purposes only and do not guarantee:
- Suitability
- Accuracy
- Availability
- Pricing
- Quality
- Delivery
You remain responsible for evaluating products before making a purchase.
5. Credits and In-App Purchases
GiftAhead may provide complimentary starter or promotional credits and offers consumable credit packs for purchase in the mobile application. A credit is used when you request the generation of a new set of gift recommendations. The number of recommendations may vary and is not guaranteed.
Credits have no cash value, cannot be transferred or exchanged for money, and do not expire while your account remains active. Complimentary credits, pack sizes, and prices may change for future grants or purchases; changes do not reduce credits already recorded in your account.
In-app purchases are offered and billed through the applicable app store, currently Google Play. The price and currency shown by the app store at checkout apply. Payment processing is governed by the app store's terms. GiftAhead does not receive your complete card or bank-account details.
Refund and cancellation requests are handled under the applicable app-store rules and mandatory consumer law. Nothing in these Terms limits statutory refund, withdrawal, or consumer rights. If a completed purchase is not credited to your account, contact support@giftahead.app.
Deleting your GiftAhead account permanently removes its remaining credit balance. Unused credits are not transferable to another account and account deletion does not itself create a right to a refund, except where required by law.
6. External Retailers
GiftAhead may display products available from third-party retailers.
Purchases are completed directly with those retailers.
These third-party gift purchases are separate from purchases of GiftAhead credits. GiftAhead is not the seller or payment processor for products purchased from external retailers and is not responsible for their shipping, returns, warranties, or customer support.
7. Acceptable Use
You agree not to:
- Use GiftAhead for unlawful purposes
- Interfere with the operation of the service
- Attempt unauthorized access to accounts or systems
- Misuse automated recommendation features
- Enter content that is unlawful, infringes another person's rights, or contains unnecessary sensitive information about another person
8. Intellectual Property
The GiftAhead application, branding, and original content are owned by GiftAhead unless otherwise stated.
Third-party product names, trademarks, and images remain the property of their respective owners.
9. Service Availability
We may modify, improve, suspend, or discontinue features at any time.
We do not guarantee uninterrupted availability.
10. Termination
We may suspend or terminate accounts that violate these Terms or misuse the service.
Users may delete their accounts at any time.
Account deletion removes stored recipients, events, preferences, and remaining credits, subject to legally required retention described in the Privacy Policy. Suspension or termination does not affect rights and obligations that arose before termination.
11. Limitation of Liability
To the maximum extent permitted by applicable law, GiftAhead is not liable for indirect, incidental, or consequential damages arising from the use of the application.
Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer protection laws.
12. Governing Law and Consumer Rights
These Terms are governed by the laws of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of residence.
The courts determined by applicable law have jurisdiction. Nothing in these Terms requires a consumer to bring a claim exclusively in Berlin where mandatory law provides otherwise.
13. Changes to These Terms
We may update these Terms when reasonably necessary, including for changes to GiftAhead, legal requirements, security, or abuse prevention. We will provide reasonable notice of material changes before they take effect and request explicit acceptance where required by law. Changes do not apply retroactively unless legally permitted and clearly stated.
